As you see from the link I posted, this type of stuff does happen.  I just like to take a little extra effort to make sure it happens to someone else, and not me. 

If you're particularly bored one night - go to YouTube and do a search for "crack WEP WPA" and watch some of these kids do it in mere minutes.  If that doesn't scare you, I don't know what will.  ;)
 
They (the "bad guys") don't even need to hack your computer, as Occam noted early, if you have a wireless network, and someone knows what they are doing, you could wind up on the wrong side of the law at least for a little while, as there have been some cases reported in media (given the prevelance of WiFi routers, and ease of setup, general laziness of people with tech stuff, and no shortage of people looking for way to do bad shit on the net and not get caught, there are probably many more instances that haven't been reported, or police haven't acted upon yet.), of people have the police come in and arrest them, because someone unknown to them was using their WiFi to download childporn.  The police were able to eventually track down the actual perp, but it took awhile and life for the initial accussd probably wasn't to pleasant until that happened. 

As for publication bans,  Alan Shanoff of the Toronto Sun (he's a lawyer) has written a few articles discussing the subject.

A Canadian Forces sergeant pleaded guilty Wednesday to hosting a website that featured gruesome images of children being sexually abused.

Gregory Kusec was an intelligence operator with the Canadian Expeditionary Command when he was arrested in February 2012.

Police seized 19 electronic devices from Kusec’s suburban Ottawa home with more than 25,000 sexualized images and movies of children, said Crown prosecutor Marie Dufort.

“At some point you stop counting,” she said.

Kusec, 44, admitted to possessing, distributing and advertising child exploitation images for more than 10 years. He was also initially charged with producing child exploitation images but that charge was dropped.

Kusec was ordered to undergo a sexual behaviour assessment before his sentencing, which is scheduled for February 10 ....

Well then, I guess that puts to bed the notion of him having a hijacked computer/net connection.  But in the vein of how all that needs to happen is to be merely accused when it comes to these sorts of crime, I watched an interesting movie starring Mads Mikkelsen (Bad Guy from Casino Royale) called "The Hunt" on my plane ride back to the sandbox.  It's fictional but I think it pretty fairly represents what would happen to a person based solely on an accusation (and in the movies case, it was a totally unfounded), and how much that can totally mess up your life.
 
As someone who works in the field of digital forensics, I can verify most of what Ocamm said. It is possible but difficult to find exculpatory evidence in cases of hijacked computers nowadays.
Some of the bot networks are so extensive - and has included gov computers - that it is pretty daunting to consider what you need to do to keep your devices safe.
First thing a user should do is enable a firewall and disable all ports, install a good virus scanner, then add them as required. A lot of the nice new media features and "client experience improvement features" won't work but you can enable them when required. Keep regular backups and a baseline image of your installation - after you have added all the applications you regularly use; as soon as you suspect something wipe the drive and re-image it with your baseline, scan your backup and restore. This process can take a day or two but that's what I do (paranoia is good).

A married and decorated military man was sentenced Monday to two years in prison for his vast and violent collection of child porn images that date back more than a decade.

Military Sgt. Gregory Kusec, 44, told court he would continue to get treatment for what a doctor diagnosed as pedophilia and sexual sadism.

Police found thousands of images on 19 devices, amassed from the time the Internet was still dial-up, court heard.
