Promoted with an Occupation Restriction

Good day all,

This one sticks, in my craw a little bit. Maybe someone can clarify how this works. A colleague of mine is getting promoted (that's great) heres what's not! This individual was caught and charged with drinking and driving, in turn lost their licence and their DND 404's for 5 years, (would have been 1, but was caught again driving with no licence so it's 5) Now the trade has accommodated this person by posting them to a possition where there is little need for them to require their 404's (fine) But how can they now promote this person when they have an occupational restriction? As stated in the career managers briefing "Acceptance of promotion signifies availability for unrestricted employment in the occupation" This person is not deployable and therefore should not be promotable, is this not correct?

P.S. 404's are a requirement in our trade.
 
Sounds like this person is lucky they didn't lose their job.  This means that for the next 5 years, this person will be a burden on others and someone else will have to be tasked when driving is involved.  Something is surely wrong here.
