Blame the victim, not the criminal.

This is ludicrous. The law states that no matter where a victim of sexual assault was, or how they were dressed, cannot be brought up in court. Yet arguments like this can? The judge should toss it out. The punishment should be 2 + years.  :rage:
 
I think if you check the history of some of the judgements this judge has handed down you are going to find she will be very lenient to the accused.
 
Law doesn't always eqaute to justice, and it is shameful to no end.

OTTAWA —A woman who suffered a traumatic brain injury after being dragged by a car driven by robbers who stole her diamond bracelet contributed to her own fate, the defence lawyer for the car’s driver argued Monday.

Ewan Lyttle said both the driver, Yonis Awais Hassan, and the victim made “grave errors in judgment” on Aug. 17, 2009, when a then-18-year-old Hassan and his 17-year-old accomplice went to the woman’s Orléans home to steal a $2,520 diamond and sapphire bracelet she had advertised for sale on the website UsedOttawa.com.

The plan went awry, according to Hassan, when the victim chased the 17-year-old to their getaway car and began “scratching and fighting” with the other teen through an open window. Hassan said he panicked and then sped away, his eyes on the road and not on what a Crown prosecutor described as the “life-and-death struggle” in the seat next to him.

Lyttle stressed that Hassan was in no way blaming the victim for what happened, but argued her actions were “legally relevant” and should play a factor when Ontario Court Justice Lise Maisonneuve sentences Hassan for aggravated assault and robbery.

But the victim, who told Maisonneuve she had entertained thoughts of suicide since the assault that left her with fractured skull, had every right to defend herself and her property and was not responsible for Hassan’s actions in any way, argued prosecutor Lisa Miles.

But Lyttle argued Hassan, an aspiring youth worker who co-operated with police following his arrest, should receive a 90-day jail sentence that could be served on weekends, followed by a lengthy period of probation.

Hassan’s 17-year-old accomplice, who can’t be named, has already been sentenced to four months of deferred custody, including house arrest.

So the "Driver" should only get 90 days, served on weekends, and probation, while the passenger (accomplice) gets four months.

Yonis Awais Hassan is an aspiring youth worker? We are all fallible and prone to mistakes but this one was a doozy. As a youth worker myself, things like honesty, accountability, and not committing robbery are important. Throw the book at him.

Let's hope that he never gets hired to work with youth, as an example to them he is not.

To be fair, he is a shining example to the ones who aspire to be gang-bangers and thugzzz.

The problem with this situation, is that lawyers tell their clients, especially ones who've screwed up this bad, that they have to try their best to make it look like they're turning their lives around so they can avoid harsher punishment. Just because he has a nice little sob story about how this has changed him, he wants to work with youth, and cooperated with the police (who had him dead to rights), etc.. DOESN'T make him a better person. Odds are, it makes him a lying, malevolent, manipulative sack of crap who wants to avoid the maximum possible sentence so he can be back out on the street with him home-boys. He's a criminal, not an idiot. Just look at the way the crime was committed. A petty thug with a double digit IQ wouldn't be able to cook that one up.

I definitely agree with throwing the book at him. Hopefully they do, and hopefully it's big one made of metal, thrown by a 'world's strongest man' competitor.
 
I don't want this "aspiring youth worker" anywhere near my, or anyone else's kids.  No doubt, however, that the police record check normally required for that line of work will likely preclude him anyway.
